This Privacy Policy explains how Thailand Care ("we", "us", "our"), operating Thailand Fertility (the "Service") at thailandfertility.com, collects, uses, and protects your personal information when you use our website or contact us about medical treatment in Thailand.
We are a referral service, not a medical provider. We connect prospective patients with independent partner clinics and hospitals in Thailand. We do not provide medical advice, diagnosis, or treatment.
This policy applies to anyone who visits the website, submits an enquiry, or otherwise interacts with us, regardless of where you live.
1. Information We Collect
Information you provide directly
- Contact details — name, email address, phone number, country of residence, preferred contact channel (e.g. WhatsApp)
- Enquiry details — the procedures you are interested in, preferred timing, budget, language preferences, and any other context you share in our forms or messages
- Health-related information — details about your medical situation, treatment history, allergies, or considerations that you voluntarily share so we can match you with appropriate clinics. We collect only what you choose to share with us
- Identity documentation — passport details may be requested by partner clinics during booking; we do not store these unless you provide them to us directly
Information collected automatically
- Usage data — pages visited, time on page, referring URLs, search terms, links clicked
- Device & connection data — IP address (which approximates your country and region), browser type and version, operating system, device type, screen size, language settings
- Cookies and similar technologies — see section 9 below
We do not knowingly collect information from anyone under 18 (see section 12).
2. How We Use Your Information
We use the information we collect to:
- Respond to your enquiries and provide personalised treatment information
- Match you with partner clinics and coordinate consultations, quotes, and bookings
- Send follow-up communications related to your enquiry; you can opt out at any time
- Operate, maintain, and improve our website and services, including analysing how visitors use the site
- Detect, prevent, and address fraud, abuse, security issues, and technical problems
- Comply with legal obligations and respond to lawful requests from authorities
3. Legal Basis for Processing (EU / UK / EEA)
If you are in the European Union, United Kingdom, or European Economic Area, we rely on the following legal bases under the GDPR and UK GDPR:
- Consent — for marketing communications and non-essential cookies. You can withdraw consent at any time
- Performance of a contract / pre-contractual steps — to respond to your enquiry and connect you with clinics at your request
- Legitimate interests — to operate our website, understand how it is used, prevent abuse, and develop our services. We balance these interests against your rights
- Legal obligation — where we must process your information to comply with applicable law
Where you provide us with health-related information, you give us your explicit consent to process it for the purpose of arranging your referral (Article 9(2)(a) GDPR). You can withdraw this consent at any time by contacting us.
4. Who We Share Your Information With
- Partner clinics and hospitals in Thailand — when you enquire about a procedure, we pass relevant details (your contact information, what you are asking about, and any context you have shared) to one or more partner providers so they can give you a quote, schedule a consultation, and coordinate your care. Once your information has been shared, the receiving clinic's own privacy practices also apply to how they handle your data
- Patient coordination partners — independent patient coordinators we work with who may be better placed to handle specific procedures or regions. Their privacy practices also apply once your details are shared
- Service providers acting on our behalf — including hosting (BunnyCDN), analytics (Google Analytics, Microsoft Clarity, Ahrefs), customer-relationship management (HubSpot), and email and messaging providers. These providers process information only to provide their services to us and are bound by contractual confidentiality obligations
- Authorities, where legally required — to comply with lawful requests, court orders, regulatory obligations, or to protect rights, property, and safety
- In connection with a business transaction — if we are involved in a merger, acquisition, sale of assets, or insolvency, your information may be transferred as part of that transaction
We do not sell your personal information, and we do not share it with third parties for their independent marketing purposes.
5. International Data Transfers
Our service is global. When you enquire from outside Thailand, your information will be transferred to Thailand and may be transferred to other countries where our partners and service providers operate.
Where you are located in the EU, UK, or EEA, we rely on appropriate safeguards for international transfers, including:
- The European Commission's Standard Contractual Clauses (or UK equivalents) where required
- Your explicit informed consent to the transfer (Article 49(1)(a) GDPR), which is necessary to fulfil your enquiry and arrange treatment in Thailand
- Adequacy decisions where applicable
By submitting an enquiry, you acknowledge that your information will be transferred internationally, including to jurisdictions whose data-protection laws may differ from those in your country of residence.
6. How Long We Keep Your Information
We retain personal information only as long as needed for the purposes set out in this policy:
- Enquiry and consultation records — up to 3 years from your last interaction with us, so we can follow up on ongoing care discussions and meet legal record-keeping obligations
- Marketing contact details — until you withdraw consent, after which they are deleted or anonymised within 30 days
- Website analytics data — generally up to 14 months in identifiable form
- Legal and accounting records — for the period required by applicable law
After these periods, information is deleted or anonymised.
7. Your Rights
Depending on where you live, you may have the following rights regarding your personal information:
- Access — request a copy of the personal information we hold about you
- Correction — ask us to correct inaccurate or incomplete information
- Erasure ("right to be forgotten") — ask us to delete your information, subject to legal exceptions
- Restriction — ask us to limit how we use your information
- Portability — receive your information in a structured, machine-readable format and transmit it elsewhere
- Objection — object to processing based on legitimate interests, including direct marketing
- Withdraw consent — at any time, without affecting the lawfulness of prior processing
California residents (CCPA / CPRA) additionally have the right to know what categories of personal information we collect and share, to request deletion, to opt out of any "sale" or "sharing" of personal information (we do not sell), and to be free from discrimination for exercising these rights.
Australia (Privacy Act 1988, APPs), Canada (PIPEDA), Brazil (LGPD), Thailand (PDPA), and other jurisdictions provide broadly equivalent rights. We honour requests from any individual exercising rights under their local data-protection law.
To exercise any right, email team@thailandfertility.com with "Privacy Request" in the subject line. We will respond within 30 days (or sooner where required by law). You also have the right to lodge a complaint with your local data-protection authority.
8. Cookies and Tracking Technologies
We use cookies and similar technologies to:
- Keep the website working (essential cookies)
- Understand how visitors find and use our pages, including via Google Analytics 4 and Microsoft Clarity (which records anonymised session recordings and heatmaps to help us improve user experience). Personally identifying form fields are masked by default in session recordings
- Measure how marketing performs, via Ahrefs Analytics
- Run our CRM and email workflows, via HubSpot
You can manage non-essential cookies through our cookie banner where available, and through your browser settings. Blocking certain cookies may affect site functionality.
9. Security
We take reasonable technical and organisational measures to protect your information against unauthorised access, loss, misuse, or alteration. These include encrypted transmission (HTTPS), access controls, and limiting who within our organisation can access your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Third-Party Links
Our website may contain links to clinic websites, partner pages, or other third-party services. We are not responsible for the privacy practices or content of those sites. Please review their privacy policies before submitting any information.
11. Automated Decision-Making
We do not make decisions about you using solely automated means that produce legal or similarly significant effects.
12. Children's Privacy
Our services are intended for adults considering medical treatment. We do not knowingly collect personal information from anyone under 18. If we learn that we have inadvertently collected such information, we will delete it. Parents or guardians who believe their child has provided us with personal information should contact us at team@thailandfertility.com.
13. Changes to This Policy
We may update this policy from time to time to reflect changes in our practices, services, or legal obligations. We will post the revised version on this page with an updated "Last updated" date. Material changes will be communicated more prominently.
